Terms of Service

By using the Carmagnum.com website and any Carmagnum mobile applications ("Services") you are agreeing to be bound by the following terms and conditions ("Terms of Use").

Basic Terms

1. You must be 13 years or older to use these Services.
2. You are responsible for any activity that occurs under your screen name.
3. You are responsible for keeping your password secure.
4. You must not abuse, harass, threaten, impersonate or intimidate other Carmagnum users.
5. You may not use the Services for any illegal or unauthorized purpose. International users agree to comply with all local laws regarding online conduct and acceptable content.
6. You are solely responsible for your conduct and any data, text, information, screen names, graphics, photos, profiles, audio and video clips, links ("Content") that you submit, post, and display on the Services.
7. You must not modify, adapt or hack the Services or modify another website so as to falsely imply that it is associated with Carmagnum.
8. You must not create or submit unwanted email to any Carmagnum members ("Spam").
9. You must not transmit any worms or viruses or any code of a destructive nature.
10. You must not, in the use of Carmagnum, violate any laws in your jurisdiction (including but not limited to copyright laws).

Violation of any of these agreements will result in the termination of your Carmagnum account. While Carmgnum prohibits such conduct and content on its Services, you understand and agree that Carmagnum cannot be responsible for the Content posted on its web site or mobile applications and you nonetheless may be exposed to such materials and that you use the Services at your own risk.

Uploads

Photos and videos that you upload or otherwise transmit to the Services shall at all times remain your sole and exclusive property. As such, you shall be solely responsible for your videos and the consequences of their posting or publication on or via the Services. Photo or video uploads, like any Submissions (as defined below), are subject to Carmagnum’s Terms of Use policy.

By submitting your photo(s) or video(s), you hereby grant Carmagnum and its affiliates, successors and assigns a worldwide, non-exclusive, royalty-free, sub-licensable (through multiple tiers) and transferable license (with a right to create derivative works to the extent necessary to make photo or video content compatible with any Services), revocable upon removing the content from Carmagnum, to use, copy, transmit or otherwise distribute, perform, modify, incorporate into other works, publicly perform and display your videos or any portion thereof, in or through any medium, whether now known or hereafter created. Carmagnum shall also be entitled to use portions of any photo and or clips of any video that has not been designated "private" for the purpose of promoting the Carmagnum site or Services, without compensation to the submitter; however, Carmagnum will not use your photos or videos for any other commercial purposes without obtaining your prior approval.

You also grant each user (or specified users, if a video is designated "private") of the Carmagnum Services a limited, non-exclusive, non-transferable, personal and non-commercial license to access and view your photos and videos through the Carmagnum Services or any other access point authorized by you and/or Carmagnum. This right to access and view your photos and videos shall include, solely to the extent necessary, the right to copy, transmit or otherwise distribute, perform, publicly perform, create derivative works of, and display your photos and videos. Unless designated "private," all photo and video uploads will be deemed public information. No photo or video upload shall be subject to any obligation of confidence on the part of Carmagnum, and Carmagnum shall not be liable for any use or disclosure of any video.

When you remove or otherwise delete a photo or video from the Services, the licenses granted by you to Carmagnum and the Carmagnum site users shall terminate within a commercially reasonable time. You understand and agree, however, that Carmagnum may retain (but not display, distribute, or perform) server copies of photos and videos that have been removed or deleted, and that Carmagnum shall have no obligation to attempt to remove from distribution any of your photos or videos that are otherwise publicly available through the Internet or other publicly accessible medium.

General Conditions

1. We reserve the right to modify or terminate the Carmagnum Services for any reason, without notice at any time.
2. We reserve the right to alter these Terms of Use at any time. If the alterations constitute a material change to the Terms of Use, we will notify you via internet mail according to the preference expressed on your account. What constitutes a "material change" will be determined at our sole discretion, in good faith and using common sense and reasonable judgement.
3. We reserve the right to refuse service to anyone for any reason at any time.
4. We may, but have no obligation to, remove content and accounts containing content that we determine in our sole discretion are unlawful, offensive, threatening, libelous, defamatory, obscene or otherwise objectionable or violates any party’s intellectual property or these Terms of Use.
5. We reserve the right to reclaim usernames on behalf of businesses or individuals that hold legal claim or trademark on those usernames.
